Huntington Beach, CA 3/26/2010 — Felix Hung with Exit Beach Cities Realty has earned the nationally recognized Short Sales and Foreclosure Resource certification. The National Association of REALTORS® offers the SFR certification to REALTORS® who want to help both buyers and sellers navigate these complicated transactions, as demand for professional expertise with distressed sales grows.

According to a recent NAR survey, nearly one-third of all existing homes sold recently were either short sales or foreclosures. For many real estate professionals, short sales and foreclosures are the new “traditional” transaction. REALTORS® who have earned the SFR certification know how to help sellers maneuver the complexities of short sales as well as help buyers pursue short sale and foreclosure opportunities.

The certification program includes training on how to qualify sellers for short sales, negotiate with lenders, protect buyers, and limit risk, and provides resources to help REALTORS® stay current on national and state-specific information as the market for these distressed properties evolves. Kelly Lise Murray, the co-founder and president of “Divorce This House(tm),” concluded a 2 day designation class for a group of close to 30 Realtors in Long Beach today. The course material covered in this designation class is the same information the American Bar Association has recommended to all of its practicing attorneys who specialize in divorce and family law.

Kelly Lise Murray who’s credentials read as a who’s who of attorneys include: graduating Phi Beta Kappa from Stanford and cum laude from Harvard Law School, a Vanderbilt law professor, family mediator, REALTOR, and FEATURED SPEAKER at the National Family Law Conference, April 10th, 2010 in New Orleans.

I was one of the Realtors who received the RCS-D (Real Estate Collaborative Specialist – Divorce) Designation and it was one of the best classes I’ve ever attended. There are so many legal landmines in divorces and it was scary to learn that most divorcees and their attorneys were often not covering ALL the issues.

Junk Fees and How to spot them

Huntington Beach – Without the proper real estate professional representing you, you may be the victim of junk fees in connection with your real estate sale or purchase transaction. After reading this blog, you will be better prepared to fend off junk fees and you will see why your neighbors in Huntington Harbour are looking to me for real estate representation.

Why junk fees? Junk fees are slipped into larger transaction (particularly in real estate) because they are often overlooked and not noticed in the sea of figures. Even the most honest and well-intentioned service providers have some junk fees, but they sometimes are hard to spot. If you are not a first-time home buyer, do you remember when you closed escrow on your current home? What was your Realtor(r) doing during the closing? Did they thoroughly review the HUD-1 settlement statement to make sure all the items were correct? Did they know the meaning and purpose of all the fees on the HUD-1? If they did not, then how would they or could they know if the item was a junk fee or not?

With the following tips, you can better protect yourself from junk fees, but nothing beats having the best real estate consultant helping you out.

Tips for avoiding junk fees:

1. When you’re buying a home, look at your GFE (Good Faith Estimate) and negotiate then to remove any junk fees.

2. Look for item that have names like, “Admin fee, transaction fee, doc prep fee,” and ask the person helping you what specifically the fee is being paid to do for you. NOTE: A doc prep fee, if it is paid to an attorney probably is NOT a junk fee.

3. Do not be worried if you see one of the following: origination fee, loan processing fee, administrative fee; BUT, you should not see more than one. They ultimately are for the same services. I personally have conducted closings for almost every major lending institution and can tell you what fees are necessary and what fees are purely to pad the profit.

4. If it is a 3rd party fee, it is a legitimate fee. On the HUD-1 settlement statement, the lender and escrow company have to disclose who the fee is being paid to. If it is to a 3rd party who is not the lender or a lender owned company, chances are, it is a necessary cost that is not negotiable.

5. Do not get fooled by the oldest trick in the book: the lowest interest rate is not always the best loan. Often buyers believe obtaining the loan with the lowest interest rate is the best loan, but this is a common mistake for many first-time and repeat home buyers. Interest rate is one of many important factors in picking a mortgage consultant. APR (annual percentage rate) is the best way of comparison. If you want a direct comparison between two mortgages, you can compare the APRs. This will tell you which loan costs less with fees added in. Since that is the case, you could have a situation where for example mortgage A has a lower interest rate but a higher APR due to fees and probably some junk fees.

6. Do not reject any fees or services without understanding the consequences. Some fees that you pay during the course of buying a home are for YOUR protection. For example, I cringe every time a buyer rejects title insurance! Although it is not required, it quite frankly very STUPID to reject this service. It is the ONLY insurance I know of that you ONLY pay your coverage once.

7. Ask for receipts. If you are paying for a service, you are entitled to a copy of the receipt to see if the provider is padding the service price (raising it for profit).

Let me conclude by giving you some more of my personal thoughts and a disclaimer here: Not all fees are junk fees. If you needed a rush service, often times a RUSH fee or expedited delivery costs are justified. I write this to help you in avoiding junk fees, but I will bluntly and honestly tell you that I WOULD advise you to go with the best mortgage consultant or real estate consultant regardless of fees, but DO pick another service provider if they can provide equally outstanding service with less fees. Advice is priceless and at the end of the day, you want a professional who is not only looking out for your pocket-book, but also making sure you have less stress and ensures your real estate transaction closes escrow.
